Service description and terms

Mazhr® is a web-based online service owned and operated by Mazhr Oy (hereinafter ”Mazhr”, “we” or ”us”) that allows users (hereinafter “Users” and “User” in singular) to access services described in this document and within the service itself (hereinafter “Service”).

To use the Service, you must register in our Service and accept these terms and conditions detailed in this document (hereinafter ”Terms”). By accessing the Service via web or through the mobile application that we provide, you confirm to have read, understood, and accepted these Terms. These Terms may be updated from time to time. Normally this happens to comply with applicable laws or in the event that new functionality is added to the Service. The amended Terms, once approved, will be posted on the Service and they indicate the date of the last revision. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms. If you do not accept the amended Terms, do not continue using the Service.

You must be 16 or over to sign-up, register or use the Service.

Service description and terms

When creating your account, you must provide accurate and complete information. You are solely responsible for the activity that occurs on your account. You must notify us immediately of any breach of security or unauthorized use of your account. We follow best practices for securing our services to all users. In case of any unauthorized use of your account (e.g., hacking) occurs, we will not be liable for any potential losses you may confront.

You agree not to use any automated system, including but not limited to, “robots”, “crawlers”, “spiders” “offline readers” etc, which would access the Service in a manner that sends more request messages to our servers than a human can reasonably produce in the same period of time by using a conventional online web browser. You agree not to collect or harvest any personally identifiable information, including account names, from the Service nor to use the communication systems provided by the Service for any commercial solicitation purposes. You agree not to use any portion of the Service as a destination linked from any unsolicited bulk messages or unsolicited commercial messages.

We may permanently or temporarily terminate, suspend, or otherwise refuse to permit your access to the Service without notice and liability, if, in our commercially reasonable determination, you violate any of these Terms or perform any of the following prohibited actions (i) attempt to interfere with, compromise the system integrity or security or decipher any transmissions to or from the servers running the Service (ii) take any action that imposes, or may impose, at our sole discretion, an unreasonable or disproportionately large load on our infrastructure (iii) upload invalid data, viruses, worms or other software agents through the Service (iv) impersonate yourself as another person or otherwise misrepresenting your affiliation with a person or entity, conducting fraud, hiding or attempting to hide your identity (v) interfere with the proper working of the Service (vi) use the Service for spamming or (vii) bypass the measures we may use to prevent or restrict access to the Service. Upon termination, you continue to be bound by these Terms.

User content

You are responsible for the content that you upload, post, provide, publish, display, link to or otherwise make available via the Service (hereinafter ”User Content”).

You agree not to post User Content that (i) may create a risk of harm, loss, physical or mental injury, emotional distress, death, disability, disfigurement, or physical or mental illness to you or to any other person (ii) may create a risk of any other loss or damage to any person or property (iii) may constitute or contribute to a crime or tort (iv) contains any information or content that is unlawful, harmful, abusive, racially or ethnically offensive, defamatory, infringing, invasive of personal privacy or publicity rights, harassing, humiliating to other people (publicly or otherwise), libelous, threatening, or otherwise objectionable (v) contains any information or content that is illegal (vi) contains any information or content that you do not have a right to make available under any law or under contractual relationships or (vii) contains any information or content that you know is not correct and current. You confirm that you have the right to post your User Content, and the User Content that you post does not and will not violate third-party rights of any kind, including without limitation any intellectual property, rights of publicity, and privacy rights.

Candidate profiles derived from the User Content may also be available, with User's permission, through the Service. Mazhr does not make any warranties for the accuracy or validity or feasibility of derived works, but the issue remains to be evaluated by the job seeker as well as the employer.

You grant Mazhr and its subcontractors used in performance of the Service the right to copy, modify, distribute, display, and perform all of the User Content you upload or post to the Service in connection with the Service, including but not limited to making your User Content available to business users according to these Terms and our privacy policy. Notwithstanding anything to the contrary, Mazhr may use and distribute anonymised statistics based on the Authorized Users’ usage of the Service. 

Mazhr does not and will not have any obligation to review User Content and therefore we do not guarantee the accuracy, integrity, or quality of User Content and we cannot assure you that harmful, inaccurate, deceptive, offensive, threatening, defamatory, unlawful, or otherwise objectionable User Content will not appear on the Service. We do, however, to the extent permitted by law, reserve the right to review any or all User Content in our sole discretion and reserve the right to remove any User Content, in whole or in part. We will endeavour to inform you of any such removal.

We process your personal information and data carefully and in accordance with our privacy policy and the applicable laws on data protection.  We collect personal information concerning you during your registration and use of the Service, as described in our privacy policy.

We use cookies for the purpose of identifying the User in our Service. Cookie use is a software technique that simplifies the use of the service and enables modification of the Web pages served in line with selections made by the user. User data is stored in ‘cookie’ files kept on the user’s computer and sent back to the server during use, so that repetitive logging during service use can be avoided. The User can set his or her browser to prevent the use of cookies altogether or to report when cookies are used. By using our Service, you accept the use of cookies.

The personal information you provide is used for the implementation, maintenance, and provision of the Service, as specified in our privacy policy.

We collect personal data from you directly and automatically on your usage of the service. You decide what you post and what you share. In addition to the personal information that you fill in yourself you may create information by usage of the service e.g. by completing self-assessments within the service. You decide who can access your personal data within the service. Some of the information you insert into the service are public (the information that you mark as available to all users), and therefore, can be accessed by all users of the service with capability to search individual users (e.g., recruiting companies). That information will not, however, be presented so that it is connected to you as an individual user, unless you have allowed that.

Our proprietary rights

Except for User Content, the Service and its materials including, but not limited to, software, images, text, graphics, illustrations, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, and music (the “Mazhr Materials“), and all intellectual property rights related thereto, are the exclusive property of Mazhr and its licensors. Unless explicitly provided herein, nothing in these Terms will be deemed to create a license in or under any such intellectual property rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit, or create derivative works from any materials or content accessible on the Service. Use of the Mazhr Materials on the Service for any purpose not expressly permitted by these Terms is strictly prohibited.

We may invite you to submit feedback, comments, questions, and other information about the Service, including without limitation about how to improve the Service or our products. By submitting any such comments, you agree that your disclosure is gratuitous, unsolicited, and without restriction and that we are free to use and disclose your comments on a non-confidential basis to anyone or otherwise use them without any additional compensation to you. 

Third-party websites and advertisers

Mazhr may contain links to third-party websites, advertisers, or services that are not owned or controlled by Mazhr. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. If you access a third-party website from Mazhr, you do so at your own risk, and you understand that these Terms do not apply to your use of such sites. We encourage you to be aware of when you leave the Service, and to read the terms and conditions and privacy policy of any third-party website or service that you visit.

Responsibility for the service and limitation of liability

The Service works, inter alia, as a service, in which (i) employers may post job opportunities and search for and evaluate candidates, and in which (ii) candidates can post their own digital profile, or parts of it, as well as search for and evaluate job opportunities. The Service does not screen or censor the postings, including available profiles. Mazhr is not involved in the actual transaction between the employers and job seekers. As a result, Mazhr is not responsible for the quality, safety or legality of User Content, posted job opportunities or digital profiles, the truth or accuracy of postings, the ability of employers to offer job opportunities to candidates or candidates' ability to fulfill available job opportunities, nor does Mazhr, give any warranties of any jobs, profiles or User Content visible in the Service. Although Mazhr reserves the right to remove User Content, profiles or other material over time in its sole discretion from the Service, it is not bound to do so and the extent permitted by the law, disclaims all liability for failing to take such measures.

Mazhr does not screen or censor the profiles or User Content from its sites, is not involved in the actual communications between Users or screen or censor published material or content of job advertisement on its sites. As a result, Mazhr has no control regarding the accuracy, reliability, completeness or precision of profiles, User Content, published notifications sent to or from the Service, and makes no warranties of any profiles or User Content in the Service.

It should be noted that there are risks involved in dealing with unknown persons, minors or persons acting under false pretenses, including, without limitation, the risk of physical damages. The User is responsible for all risks associated when dealing with other Users to whom the User come in contact through the Service. Information of other people may, in itself, be offensive, harmful or inaccurate, and in some cases they are named incorrectly or in a misleading manner. We expect Users to exercise caution and common sense when using the Service.

Because user authentication on the Internet is difficult, Mazhr can not and does not confirm that each User is who he/she claims to be. Because we do not participate and cannot participate in peer-to-peer interaction between Users or control the behavior of participants on the Service, so in the event that a User has a dispute with one or more of the other Users, the User releases Mazhr and its representatives, directors and employees to the extent permitted by law in all kinds and nature known and unknown suspicions and unexpected, disclosed and undisclosed claims, demands and damages (direct and indirect) arising out of such disputes, or are related in some way.

The Service may contain inaccuracies or typographical errors. Mazhr makes no warranties of accuracy, reliability, completeness or timeliness of any content in the Service site. All use of the Service and its content is at User's own risk. Site changes are made periodically, and can be done at any time. 

Mazhr encourages Users to maintain a backup copy of all of their User Content. Mazhr is not, to the extent permitted by the law, under any circumstances responsible for any deletion, loss or unauthorized modification of User Content in the Service.

THE SERVICE IS PROVIDED TO YOU ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL MAZHR, ITS AFFILIATES, DIRECTORS, EMPLOYEES OR ITS LICENSORS BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER LOSSES, THAT RESULT FROM YOUR USE OF, OR INABILITY TO USE, THIS SERVICE. 

THE MAXIMUM LIABILITY OF MAZHR FOR THE USE OF THE SERVICE AND ITS CONTENTS, TO THE EXTENT PERMITTED BY THE LAW, DOES NOT EXCEED 10 € (TEN EURO) REGARDLESS OF THE CAUSE OF ACTION (WHETHER IT IS AN AGREEMENT LIABILITY, AGAINST THE LAW, BREACH OF WARRANTY OR OTHER).

Duration, termination and amendments

These Terms remain in full force and effect as long as you are a User of the Service. Mazhr reserves, in its sole discretion, the right including without limitation to delete User Content from the Service and terminate immediately the registration or User’s license to use the Service, if the User breaches any of these Terms or if Mazhr cannot ensure or verify the information that the User sends when registering to the Service site. Certain provisions of these Terms will remain in force even when you are no longer the User of the Service.

Mazhr has the right to at any time add, amend and remove parts of the Service, discontinue the Service temporarily or permanently to implement new features as well as to add new terms and conditions for any feature. 

Payment and Refund Policy

The Platform is a paid service and the payments made by you shall be according to the test plans opted by you through the Mazhr platform. All payments by Users shall be through the payment mechanism put in place by us. Users have been given various options to choose and proceed with the payment for the Services via payment mechanisms including but not limited to Card Payment facilities, EMI Payment, Online Bank Transfer, and Wallet Payment. The payment gateway mechanisms are governed by the terms and conditions of the third-party providers as listed on the Platform and the User agrees to be bound by those terms.

Valid Credit / Debit/ Cash Card/ online bank transfers and other payment instruments are processed using a Credit Card payment gateway or appropriate payment system infrastructure and the same will also be governed by the terms agreed to between the Users and the respective issuing bank and payment instrument issuing company. We shall not be liable for any unauthorised use, fraud, payment refunds, lost amount, etc., in the transaction.

Due to the digital nature of the training and software, we are unable to provide refunds on any test purchases.

In most cases, you have paid for services and/or products and seen the results of using them. If you do not see ROI, or return on investment, it's only because of the individual person's effort to improve himself.

General

The laws of Finland will govern these Terms, as well as any claim that might arise between you and us, without regard to conflict of law provisions. All disputes arising under or in connection with these Terms and/or the Service will be primarily settled in negotiations between the parties. If the parties are unable to reach an agreement in such negotiations the disputes will be settled in Helsinki district court at the first instance.

You may not assign or transfer any rights and licenses granted hereunder.
